Privacy Notice on CCTV Use

PRIVACY POLICY

This privacy policy is to let you know how the Company collect, use and disclose personal data, as well as to identify the relevant processing purposes and also describe your rights as a data subject.

1. TYPES OF PERSONAL DATA WE COLLECTED 

Our CCTV captures images of all individuals and their belongings (e.g. bag) entering the monitored area in our premises and facilities and may collect photos or videos of you. 

2. HOW WE PROCESS YOUR PERSONAL DATA

2.1 We may collect, use, disclose, or process your personal data, for the following purposes

(a) to protect individuals’ life, body, health, personal safety, and belongings;
(b) to protect and prevent our premises, facilities and assets from damage, disruption, vandalism, and other crime;
(c) to support law enforcement agencies in the prevention, detection, and prosecution of crime and to act as a deterrent against crime;
(d) to assist in the effective resolution of disputes which arise in the course of disciplinary or grievance proceedings;
(e) to assist in the investigation or proceedings concerning a whistleblowing complaint; and
(f) to assist in the establishment or defense of any civil litigation, including but not limited to employment proceedings.

2.2 Our CCTV is in operation 24 hours a day, except in case of system failure or maintenance.

2.3 We place appropriate signage in the monitored areas to alert you that a CCTV installation is in use and your personal data is recorded.

3. LEGAL BASES 

We may collect, use, disclose, or process your personal data on any of the following legal bases. 

(a) Vital interest. 
The collection, use, disclosure, or processing is necessary for the prevention or suppression of a danger to a person’s life, body, or health. 

(b) Legitimate interest. 
It is in our legitimate interest to collect, use, disclose, or process, your personal data to achieve any of the purposes described above. 

(c) Legal obligations. 
We owe a duty to comply with the legal obligations prescribed by the applicable laws, including but not limited to the laws regarding safety and environment in the workplace. We consider the use of CCTV as a necessary measure to enable us to meet those obligations.

4. Disclosure of Your Personal Data to Third Parties

4.1 We may disclose your personal data to third parites (including our affiliates and service providers) if we consider that the disclosure is necessary for the purposes described above.

4.2 We may disclose your personal data to law enforcement agencies if the disclosure is necessary for compliance with our legal obligations and to support or assist them in the prevention, detection and prosecution of crime.

5. Period of Retention

5.1 We may retain your personal data no longer than as is necessary to achieve the purposes described in this notice or as in required by applicable laws. We may need to retain your personal data for so long as is necessary to deal with any disputes or legal proceedings that may arise.

5.2 If we no longer need to retain your personal data, we may destroy, delete, remove or anonymize your personal data.

6. YOUR RIGHTS

You have the following rights pursuant to the laws:

(a) Right of access. You have the right to access and obtain a copy of your personal data or request to disclose your personal data. The request must be in writing and sent to the channel in the “CONTACT US” section. Your request will be processed within the period required by law. We may, to the extent permitted by law or a court order, refuse to act on your request where such request could affect the rights and freedom of another person.

(b) Right to rectification. You have the right to have incomplete, inaccurate, misleading, or not up-to-date personal data that we process about you rectified.

(c) Right to data portability. You may have the right to obtain your personal data we hold, in a structured, electronic format, and transmit such data to another data controller, where this is (a) personal information which you have provided to us, and (b) if we are processing that data on the basis of your consent.

(d) Right to object. You have the right to object to the collection, use, or disclosure of your personal data for the purposes of achieving our legitimate interest (or that of other persons). We may refuse to comply with your request if we can demonstrate compelling legitimate grounds for such collection, use, or disclosure, which may override your own interests or if such collection, use, or disclosure is for the purposes of establishment, compliance, exercise or defense of legal claims.

(e) Right of erasure. You have the right to request us to erase or destroy your personal data or to anonymize your personal data if you believe that (i) the personal data is no longer needed for the purposes described in this notice or (ii) the collection, use, or disclosure of your personal data is unlawful. We may refuse to comply with your request for erasure or destroy for the purposes of establishment, compliance, exercise or defense of legal claims, or compliance with laws.

(f) Right to restrict processing. You have the right to request us to suspend the use of your personal data if you believe that we no longer need to retain the personal data for the purposes described in this notice, but you still require the retention for the purposes of establishment, compliance, exercise or defense of legal claims, or compliance with laws.

(g) Right to withdraw consent. If you have consented to our collection, use, or disclosure of your personal data, you have the right to withdraw that consent at any time.

(h) Right to lodge a complaint. You have the right to file a complaint against us to the relevant data protection supervisory authority if you believe that we breach or do not comply with any of our obligations under the applicable personal data protection laws

บริษัทโตโยต้า โบโชคุ เอเซีย จำกัด (“บริษัท”) ใช้กล้องวงจรปิดภายในสถานที่ของบริษัทในการบันทึกพื้นที่เฉพาะ เพื่อการรักษาความปลอดภัยและความมั่นคงของสถานที่ ทรัพย์สิน พนักงาน ลูกค้า และผู้มาติดต่อของบริษัท ประกาศ การคุ้มครองข้อมูลส่วนตัวฉบับนี้อธิบายการเก็บรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคลของท่านที่บริษัทเก็บ รวบรวมโดยใช้กล้องวงจรปิด

1. ประเภทของข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวม

กล้องวงจรปิดของบริษัทบันทึกภาพของบุคคลทุกคน รวมทั้งทรัพย์สินของบุคคลเหล่านั้น (เช่น กระเป๋า) ซึ่งเข้ามา ในพื้นที่ภายใต้การสอดส่องดูแลที่อยู่ภายในสถานที่และสิ่งอำนวยความสะดวกของบริษัท และอาจเก็บรวบรวม ภาพถ่ายหรือภาพวีดีโอของท่านไว้

2. วิธีการที่บริษัทประมวลผลข้อมูลส่วนบุคคลของท่าน

2.1 บริษัทอาจเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ดังต่อไปนี้

(ก) ปกป้องคุ้มครองชีวิต ร่างกาย สุขภาพ ความปลอดภัยส่วนบุคคล และทรัพย์สิน
(ข) ปกป้องคุ้มครองและป้องกันสถานที่ สิ่งอำนวยความสะดวก และสินทรัพย์ของบริษัทจากความเสียหาย การถูกรบกวน การถูกทำลาย และอาชญากรรมอื่น ๆ
(ค) การสนับสนุนหน่วยงานที่มีหน้าที่บังคับใช้กฎหมายในการป้องกัน สืบสวน และดำเนินคดีทางอาชญา และ การดำเนินการเพื่อการยับยั้งอาชญากรรม
(ง) การช่วยเหลือในการระงับข้อพิพาทที่เกิดขึ้นในการดำเนินการทางวินัยหรือการร้องทุกข์ได้อย่างมีประสิทธิภาพ
(จ) ช่วยในการสอบสวนหรือกระบวนการที่เกี่ยวกับการแจ้งเบาะแส และ
(ฉ) ช่วยในการฟ้องหรือต่อสู้คดี ซึ่งรวมถึงแต่ไม่จำกัดเพียง การดำเนินคดีแรงงาน

2.2 กล้องวงจรปิดของบริษัททำงานตลอดยี่สิบสี่ชั่วโมง เว้นแต่ในกรณีที่ระบบขัดข้องหรือมีการซ่อมบำรุงระบบ

2.3 บริษัทได้ติดตั้งป้ายเพื่อแจ้งเตือนให้ทราบถึงการใช้กล้องวงจรปิดและการบันทึกข้อมูลส่วนบุคคลของคุณ ในพื้นที่ ภายใต้การสอดส่องดูแลตามสมควร

3. ฐานทางกฎหมาย

บริษัทอาจเก็บรวบรวม เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลของท่าน โดยอาศัยฐานทางกฎหมายดังต่อไปนี้

(ก) ฐานประโยชน์สำคัญต่อชีวิต การเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลนั้นเป็นการจำเป็น เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล

(ข) ฐานประโยชน์อันชอบด้วยกฎหมาย การเก็บรวบรวม ใช้ เปิดเผย หรือประมวลผลข้อมูลส่วนบุคคลเป็นการ ดำเนินการเพื่อประโยชน์อันชอบด้วยกฎหมายของบริษัท เพื่อบรรลุวัตถุประสงค์อย่างใดอย่างหนึ่งตามที่ ระบุข้างต้น (ค) ฐานหน้าที่ตามกฎหมาย บริษัทมีหน้าที่ต้องปฏิบัติตามหน้าที่ที่กำหนดโดยกฎหมาย ซึ่งรวมถึงกฎหมาย ว่าด้วยความปลอดภัยและสิ่งแวดล้อมในสถานที่ทำงาน บริษัทเห็นว่าการใช้กล้องวงจรปิดเป็นมาตรการ ที่สำคัญซึ่งช่วยให้บริษัทสามารถปฏิบัติตามข้อกำหนดเหล่านี้ได้

4. การเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลที่สาม

4.1 บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบุคคลที่สาม (รวมถึงบริษัทในเครือและผู้ให้บริการของบริษัท) ในกรณีที่บริษัทพิจารณาว่ามีความจำเป็นต้องเปิดเผยข้อมูลส่วนบุคคลนั้นเพื่อวัตถุประสงค์ตามที่ระบุข้างต้น

4.2 บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อหน่วยงานที่มีหน้าที่บังคับใช้กฎหมาย หากมีความจำเป็นเพื่อการ ปฏิบัติหน้าที่ตามกฎหมายของบริษัท และเพื่อสนับสนุนหรือช่วยเหลือหน่วยงานที่มีหน้าที่บังคับใช้ กฎหมาย ในการป้องกัน สืบสวน และดำเนินคดีอาชญา

5. ระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคล

5.1 บริษัทอาจเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ไม่เกินกว่าระยะเวลาเท่าที่จำเป็นเพื่อการบรรลุวัตถุประสงค์ตามที่ ระบุในประกาศฉบับนี้ หรือเท่าที่จำเป็นตามกฎหมายที่ใช้บังคับ อนึ่ง บริษัทอาจจำเป็นต้องเก็บรักษาข้อมูลส่วนบุคคล ของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นเพื่อการจัดการข้อพิพาทหรือกระบวนการทางกฎหมายซึ่งอาจเกิดขึ้น
5.2 ในกรณีที่บริษัทไม่มีความจำเป็นในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน บริษัทอาจทำลาย ลบ นำออกจากระบบ หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลได้

6. สิทธิของท่าน ท่านมีสิทธิตามกฎหมายดังต่อไปนี้

ก) สิทธิการเข้าถึง ท่านมีสิทธิเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน หรือขอให้มีการเปิดเผยข้อมูล ส่วนบุคคลของท่าน โดยแจ้งความประสงค์เป็นลายลักษณ์อักษรและส่งไปยังช่องทางตามที่ระบุไว้ในส่วน “การติดต่อบริษัท” คำขอของท่านจะได้รับการพิจารณาภายในระยะเวลาที่กฎหมายกำหนด บริษัทอาจ ปฏิเสธที่จะปฏิบัติตามคำขอของท่านได้ในกรณีที่คำขอนั้นอาจมีผลกระทบต่อสิทธิและเสรีภาพของบุคคลอื่น ทั้งนี้เป็นไปตามที่กฎหมายกำหนดหรือโดยคำสั่งศาล

(ข) สิทธิการแก้ไขให้ถูกต้อง ท่านมีสิทธิขอให้มีการดำเนินการแก้ไขข้อมูลส่วนบุคคล ซึ่งบริษัทได้ประมวลผล เกี่ยวกับท่านให้สมบูรณ์ ถูกต้อง ไม่ก่อให้เกิดความเข้าใจผิด หรือเป็นปัจจุบัน

(ค) สิทธิการโอนย้ายข้อมูล ท่านอาจมีสิทธิขอรับข้อมูลส่วนบุคคลของท่านที่บริษัทมีอยู่ในรูปแบบอิเล็กทรอนิกส์ ที่มีการจัดเรียงแล้ว และส่งข้อมูลส่วนบุคคลนั้นไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น ในกรณี (ก) ข้อมูล ส่วนบุคคลที่ท่านได้ให้กับบริษัท และ (2) กรณีที่บริษัทประมวลผลข้อมูลนั้นโดยอาศัยฐานความยินยอมจากท่าน

(ง) สิทธิการคัดค้าน ท่านมีสิทธิคัดค้านการเก็บรวบรวม การใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลของท่าน ซึ่งมีวัตถุประสงค์เพื่อการบรรลุประโยชน์โดยชอบด้วยกฎหมายของบริษัท (หรือของบุคคลอื่น) ได้ บริษัท อาจปฏิเสธที่จะปฏิบัติตามคำขอของท่านในกรณีที่บริษัทสามารถแสดงได้ว่ามีเหตุอันชอบด้วยกฎหมาย ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าวซึ่งอาจสำคัญยิ่งกว่าประโยชน์ของท่าน หรือ ถ้าการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าวเป็นไปเพื่อก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย

(จ) สิทธิการลบหรือทำลายข้อมูล ท่านมีสิทธิขอให้บริษัทดำเนินการลบหรือทำลายข้อมูลส่วนบุคคลของท่าน หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลได้ หากท่านเห็นว่า (1) ข้อมูลส่วนบุคคลนั้นหมดความจำเป็นสำหรับวัตถุประสงค์ที่ระบุในประกาศฉบับนี้แล้ว หรือ (2) ข้อมูล ส่วนบุคคลของท่านได้ถูกเก็บรวบรวม ใช้ หรือเปิดเผยโดยไม่ชอบด้วยกฎหมาย ทั้งนี้ บริษัทอาจปฏิเสธที่จะ ปฏิบัติตามคำขอให้ลบหรือทำลายข้อมูลส่วนบุคคลของท่านได้ เพื่อการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย การยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือ การปฏิบัติตามกฎหมาย

(ฉ) สิทธิการจำกัดการประมวลผล ท่านมีสิทธิขอให้บริษัทระงับการใช้ข้อมูลส่วนบุคคลของท่าน หากท่าน เห็นว่าบริษัทหมดความจำเป็นในการเก็บรักษาข้อมูลส่วนบุคคลนั้นเพื่อวัตถุประสงค์ตามที่ระบุในประกาศ ฉบับนี้แล้ว แต่ท่านยังต้องการให้เก็บรักษาข้อมูลส่วนบุคคลนั้นไว้เพื่อการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย การยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย หรือ การปฏิบัติตามกฎหมาย

(ช)สิทธิการถอนความยินยอม ในกรณีที่ท่านได้ยินยอมให้บริษัทเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วน บุคคลของท่าน ท่านมีสิทธิที่จะถอนความยินยอมนั้น ณ เวลาใดก็ได้

(ซ) สิทธิการยื่นเรื่องร้องเรียน ท่านมีสิทธิยื่นเรื่องร้องเรียนบริษัทต่อหน่วยงานกำกับดูแลการคุ้มครองข้อมูล ส่วนบุคคลได้ หากท่านเห็นว่าบริษัทฝ่าฝืนหรือไม่ปฏิบัติตามหน้าที่ใด ๆ ของบริษัทตามกฎหมายว่าด้วย การคุ้มครองข้อมูลส่วนบุคคล
